Failing To Understand The One Percenter Concept

The One Percenter Code, by Dave Nichols, presents a life style that seems very contradictory.

Why would people who are self-proclaimed rebels tie themselves in with an organization that demands strict observance of very tight rules? That’s what I don’t get about the outlaw motorcycle clubs.

I’m reading The One Percenter Code: How To Be An Outlaw In A World Gone Soft, by Dave Nichols. This is not a review of the book; I’ll put that up on Examiner.com when I’ve finished reading it. This is just me musing over the things I’ve been reading in this book that make me shake my head and wonder.

The main question is the one I already stated. Nichols, as well as other writers whose work I’ve seen, makes a big deal about how outlaw bikers give a big middle finger to authority. And yet the demands of the clubs themselves are so far stricter than anything society tries to impose. (Before I go any further, I want to make clear I have no first-hand knowledge of these things; I’m just going by what I read. If these writers are full of it your issue is with them, not me.)

So for instance, Nichols says that when the club goes on a ride all members are required to stay with the group at all times. That is so totally opposite of what I want to do when I ride. I’ll stay with the group, but if I want to do something other than what they group does, I’ll just say fine, I’ll meet up with you later. Don’t anybody try to tell me I’ve got to stay with the group!

And becoming a member! Oh man, it sounds like a military academy carried to an extreme. If you’re a prospect you are at the whim of every member who tells you what to do and you do it, period, or else. This is called showing your dedication and commitment. I call it a bunch of bull and I would never be party to any such arrangement. That’s part of the reason I never joined the army, never pledged a fraternity, any of that stuff. I don’t take that crap from anyone.

Then there’s the casual way that Nichols describes any number of ways to get your ass whipped by outlaw bikers if you don’t follow their rules of conduct. Never mind that “citizens,” as we non-club members are called, probably don’t have any idea these so-called “rules” exist. Nichols does note that in public places the club members do cut us citizens some slack, but hey, I don’t buy off on your rules. Don’t think you have some right to pound the crap out of me because I did something that annoyed you. And what’s with the freakin’ violence anyway? I’m not a big guy at all, so just because you can beat the crap out of me doesn’t make you good or right or better than me or anything, it just makes you a jerk.

Now to hear Nichols tell it, violence is a way of life for one percenters, but I suspect it’s not quite that extreme. I’m guessing there are plenty who are actually nice people and they get tarred by bad behavior of the minority. But there are two things that are absolutely clear here: I don’t want any part of the one-percenter life and no one-percenter club wants anything to do with me.

ABATE Statewide Tour Adds Extra Interest To Your Colorado Rides

OK, you’re going to be riding around Colorado as much as possible this year no matter what. Are you interested in an something that can perhaps introduce you to places you’ve never been, and that might also put some cash in your pocket?

The more you get around Colorado this year the greater your chance of winning some cash.

Oh, caught your interest, did I?

Here’s the deal. ABATE of Colorado is doing a fundraiser, for the second time, where you can purchase ($15) a Colorado Statewide Tour 2012 Passport Book that lists 178 businesses, points of interest, events, and other things. Each time you go to one of these you document it–receipt, signature, photo, whatever–and at the end of the year you turn your book in. For every five points you have checked off you get one entry in a drawing with three prizes: $1,000, $500, and $250.

Now, we all know that the odds with a drawing are that you will not win. Although three somebodies in this case will win. So while winning would be sweet indeed, it’s only a remote reason for playing. The real reasons are two-fold: Discovering new places or revisiting cool places you’ve been before, and raising money for ABATE.

The first reason needs no explanation. Why should you care about funding ABATE? Well, it seems like every legislative session that some bill gets introduced that motorcyclists get very interested in. Some we like, some we don’t. If we like them we want to support them; if we hate them we want to fight them. ABATE is our proxy in that effort. No motorcycling group in the state has more influence down at the gold dome.

Enough about that. What are some of the spots on the list? Here’s a random selection.

‘Unconventional Attire’ Bill Goes Nowhere

That didn’t take long. One day a bill came up for consideration in the Colorado House that would prohibit businesses from barring bikers from their establishments because they are wearing colors. The next day that bill was killed on a 6-3 vote in the State, Veterans, & Military Affairs Committee.

The bill, HB 1128, was proposed by Rep. Joe Miklosi, at the urging of constituents who belong to the Veterans of Vietnam America Motorcycle Club. I would assume it also had the support of the Colorado Confederation of Clubs, considering that they are whole-heartedly against businesses that ban erstwhile customers wearing colors. Just an assumption, but I could be wrong.

As an aside, here’s the Biker Friendly Or Not page on the CCC’s website where they list establishments that sit on both sides of that fence.

The vote in this case was not strictly a party-line vote. With five Democrats and four Republicans on the committee, the three who sought to keep the bill alive were all Democrats but two Dems joined with all four Republicans to “postpone the bill indefinitely.”

I have to think this was another situation where the biker community, at least those of the cruiser persuasion, and the Republicans who they generally work in concert with, ran into some friction. They would seem to be opposing views of freedom, i.e., the freedom of business owners to run their businesses as they see fit vs. the freedom of individuals to dress as they choose without fear of retribution.

There was a time years ago when my buddies and I went out to a bar on our bikes and were denied entrance because we were wearing motorcycle jackets. No colors or anything, just jackets. We figured that was pretty absurd. And you can bet we’ve never been back to that bar.

On the other hand, “No shirt, no shoes, no service” is a common sign and people seem to accept that with no argument. So the issue would come down to how you write a law that goes far enough without going too far. You probably can’t, so maybe it’s just best to leave it alone. The government doesn’t need to make the rules on everything.

Bill To Kill MOST Program Defeated; Now It Is ‘Fix It Or Lose It’

Senate Bill 89, which would have eliminated Colorado’s Motorcycle Operator Safety Training (MOST) program, died in committee Tuesday. But the senators who wish to give reform efforts a chance to succeed made it clear they will vote differently in the future if the program is not fixed.

The idea that the program has problems was not contested by anyone. The only discussion was on whether to kill the program outright or first let those involved with MOST do what they can to fix it. On a party line vote, the majority Democrats on the committee voted for the latter while the minority Republicans voted to kill the program.

In arguing for killing MOST, Sen. Scott Renfroe, the bill’s sponsor, challenged the need for such a program and said it was an area in which the government need not get involved. Sen. Renfroe made it clear he supports rider training, pointing out that he himself rides motorcycles, but that he feels the program has outlived its usefulness.

Opponents of the bill expressed concerns that killing MOST could result in the loss of an annual $100,000 grant for motorcycle safety efforts from the National Highway Transportation Safety Administration. They also said that in talks with the Colorado Department of Revenue (DoR), DoR had made it clear that if MOST was killed, the department would no longer accept Beginning Rider Course certification in lieu of the department’s own testing of riders seeking to get licensed. Sen. Renfroe said he questioned whether DoR would in fact do that.

If DoR did do that, opponents pointed out, it would mean that the expense of testing, which is currently borne by the riders taking the courses, would fall on DoR, driving up government expenses.

Sen. Renfroe pointed to results of a survey conducted among riders who had taken the courses, saying that the riders themselves stated overwhelmingly that an increase in the price of the class would not have deterred them from taking them. Speaking for the Colorado Department of Transportation, which supported allowing time for the program to be fixed, Herman Stockinger pointed out that in fact, the survey showed that nearly 50 percent had said a $70 increase would indeed have caused them to reconsider. Seventy dollars per student is the amount that rider training is subsidized through MOST.

“That’s perhaps 4,000 plus people (per year) who wouldn’t have taken the training,” said Stockinger.

So MOST has a reprieve but it is not out of the woods. It is now up to those involved with MOST to put into effect the recommendations of a legislative audit report. And if those recommendations are not enacted, the next time this issue comes up the outcome could be very different.

Hearing Set For Tuesday On MOST Repeal

As mentioned previously, a bill has been introduced that would eliminate the state’s Motorcycle Operator Safety Training (MOST). There will be a hearing on that bill at 2 p.m. on Tuesday, Feb. 21, in Room SCR 352 at the state capitol. ABATE of Colorado is urging all who can to attend and lend support for the continuation of the MOST program.

MOST is a program that was created at the request of motorcyclists to help defray training costs so that more riders will have better riding skills. The program is funded through a $4 per year additional fee on motorcycle license renewals and an additional $2 every time someone with a motorcycle accreditation on their driver’s license renews that license.

Aside from eliminating the program, SB12-089 makes no provision for what is to be done with the money already paid into the program should MOST be eliminated, which would presumably mean that money would simply stay in the state’s general fund.

The bill to eliminate MOST is sponsored by Sens. Renfroe, Cadman, Grantham, Harvey, Lambert, Lundberg, Mitchell, Neville, Roberts, Scheffel, and Spence, and in the House, by Reps. Holbert and Sonnenberg.

Anyone planning to attend the hearing should check first to ensure that it has not been rescheduled. The bill was originally scheduled for hearing on Feb. 14, but was postponed. If it is postponed there should be a notice to that effect on the ABATE site.

ABATE Lobby Day Is A Time To Make Our Concerns Known

The term “lobbyist” often carries a negative connotation but in fact, whenever you or I contact our elected representatives about an issue that concerns us, we are lobbying. If the citizens of a representative democracy–which is what we have–did not express their concerns their elected officials would be hard put to know what mattered to the folks back home.

ABATE of Colorado has designated April 20 as ABATE Lobby Day at the state capitol. As the notice states, “This day is to introduce ABATE to new legislators and say hi to those who already know us. We’d like you to get the experience of interacting with our public servants.”

What an idea. Get a bunch of folks who have common interests–in this case, regarding motorcycling issues–to meet with their elected officials and build a relationship. And in the course of building that relationship, make those officials aware of issues and concerns they may very well have no knowledge of at all.

Take the MOST program, for example. The Motorcycle Operator Safety Training program is a program that trains riders in riding skills. It is paid for by a surcharge each of us pays when we renew our licenses and plates. It’s something we requested. And now it’s being threatened by people who don’t seem to understand that this is how it came to be and who somehow feel it is wrong that they have to pay an amount less than what they would drop on a cup of coffee at Starbucks for something that benefits all motorcyclists.

Most legislators probably have never even heard of MOST. Go meet with your reps and talk to them about it, and other issues as well. Even if you also oppose MOST, it’s better if they understand what it is and why people support it and oppose it.

So the date is April 20. This is not something ABATE is setting up; you’ll need to contact your legislator on your own and make an appointment with them on that day. ABATE is just coordinating things so, with any luck, there will be a significant amount of black leather and such all there at the capitol at one time. Strength in numbers, you know?

A Cheaper Way to Ship Your Bike and Ride It Home

If you’re like most touring motorcyclists you’re limited as to how far you can go by the amount of time you have off from your job. One way to expand your horizons is to ship your bike to some far-off destination, then fly out there and ride the bike home. But I’ve looked into this and it is pretty expensive. Not out of the question but darn pricey.

There’s another option and it could save you a lot of money. Using a website called uShip.com, you can post a notice as to what you want to ship, when, from where to where. Then carriers bid on your load, trying to undercut the competition in order to win your business. Once you select the bid you want to go with you are put in touch with that shipper. Afterward you both provide feedback which builds confidence on both sides for future shippers/carriers.

I had never heard of this site until they contacted me recently to inquire about placing an ad here on the Passes & Canyons website. That’s their text link over in the right-hand column, just below my picture. When Carlos told me what their business was I said hey, I want to do a post about you guys just to let people know you exist, because I think what you’re doing is great!

As I said, I’ve looked into shipping the bike before and it’s not cheap. But looking at the listings on the site right at this moment, here’s what I see. There’s a guy in Cheyenne who wants to ship his 1997 Honda Z50 to Austin, TX, and he has a low bid right now of $225. There’s another guy in Grand Junction who wants to send his 2001 Indian Scout to Lancaster, CA, and has a low bid of $532. Then another guy there in Junction has 1975 Suzuki re5 Rotary that he wants to ship to Sydney, Australia. He doesn’t have any bidders yet.

There are a lot of bikes waiting for bids. As a matter of fact, there might be a business opportunity here for someone with a truck. String a few of these shipments together and you could make some money.

So it’s free to list your load, and presumably (I didn’t dig deeply here) the hauler pays a percentage of the shipping fee to the folks running the site. Clearly there’s no guarantee, so if you absolutely have to get a bike to particular place by a specific date this might not work for you. But it might. And you’ve got nothing to lose by trying. The more flexible you can be, the better, I’m sure.

Then couple inexpensive shipping with a cheap airplane ticket and you could be set for a terrific ride in places you’ve just never had time to get to before. I tell you what, I’m going to be checking this out myself this summer. Judy and I have spoken numerous times of shipping the bike to Seattle or somewhere like that, flying out, and riding back. It just might happen.

AMA Urges Comments on Resource Management Plan That Would Limit Riding

January 17 is the deadline for comments on a proposed Resource Management Plan (RMP) put together by the Colorado River Valley (CRVO) Glenwood Springs field office of the federal Bureau of Land Management (BLM). After studying the plan the American Motorcyclist Association (AMA) has issued an alert stating that “The current proposed RMP calls for a significant decrease in the number of miles for off-highway vehicle use as well as a total elimination of all cross country travel,” and urging motorcyclists to register their concerns with the plan. Limitations proposed by the plan include the following.

  • Eliminate all cross-country travel currently allowed on 123,000 acres
  • Decrease designated route mileage for full-size vehicles from 760 miles to 470 miles
  • Decrease designated route mileage for ATVs from 82 miles to 62 miles
  • Decrease designated single-track route mileage for motorcycles from 85 miles to 66 miles
  • Closure of an additional 47,900 acres currently open to snowmobile recreation
  • Closure to snowmobile usage on anything other than a trail on an additional 14,800 acres

The particular issues the AMA has with the plan, and what they consider the talking points to be raised in making comments, include the following.

  • There is a lot of information provided in the plan for different uses; however it is disorganized and hard to review.
  • Travel management analysis and decisions appear to have been overlooked in the development of the plan and there is no analysis offered as to why all routes closed to motorized usage are assumed to be available for non-motorized and mechanized usage going forward. The lack of analysis for travel management related issues is a violation of NEPA’s requirements for a detailed statement of high quality information of why decisions in the Plan have been made.
  • Motorized users are the only loser in the plan as travel management is the first tool used to address management issues that have nothing to do with travel management, like big game hunting issues and cave management.
  • Alternative D is the best alternative but it still fails to address usage trends on the CRVO.
  • Alternative C is very weak scientifically and violates both state and federal planning guidelines.
  • The Plan moves to a fully designated trail system for all users; however the stated benefits of the proposed changes are simply not addressed. The Plan does not analyze why this protection is not enough and further closures are necessary, when most habitat management plans never identify the need for any trail closures to protect the species.
  • Loss of the Gypsum Hills Special Recreation Management Area (SRMA) is unfair and runs counter to the reason it was originally created (to off-set the impacts of two Wilderness Study Areas (WSA’s). The WSA’s are still present and the SRMA should not be removed until there is a proposal to re-open the WSAs.
  • User conflicts are often overstated to obtain closures for other reasons and most user conflicts can be addressed without the closures of trails and roads.
  • Closure of the Hardscrabble Area for motorized access and subsequent designation of the Hardscrabble area for targeted recreational motorsports activities is inconsistent. This plan fails to give any analysis of the existing motorized opportunities that will be lost in the Hardscrabble area.
  • Many of the Wilderness characteristic areas and areas of critical environmental concern designations are inconsistent or conflicting.
  • Many proposed management standards violate multiple usage requirements such as the standard of managing all big game habitats to optimum standards
